Utah Misdemeanor Cases

A misdemeanor is a far less serious crime than a Felony. Penalties for a misdemeanor crime may include up to one year in a county jail and/or fines that total $4,750 or less. There are three levels of misdemeanor charges in the State of Utah:

Class C

  • Examples: Driving with a suspended license, driving without a valid license, disorderly conduct and public intoxication
  • Possible penalties: Serve up to 90 days in jail and pay up to $1000 in fines, enroll in education or treatment related classes and receive court or supervised probation

Class B

  • Examples: Possession of one ounce or less of marijuana, possession of drug paraphernalia, reckless driving and other traffic offenses, assault, resisting arrest, DUI, trespassing, theft with a value of $500 or less, creating a public nuisance, and carrying a concealed weapon
  • Possible penalties: Serve up to six months in county jail, pay up to $1,940 in fines, enroll in educational or treatment related classes, and receive court or supervised probation

Class A

  • Examples: Possessing between one ounce to one pound of marijuana, criminal mischief, assaulting a police officer, theft with a property value of $500 to $1,500, DUI with injury, providing false information to an officer, negligent homicide, and violation of a protective order
  • Possible penalties: Serve up to one year in county jail, pay up to $4,750 in fines, enroll in educational or treatment related classes, and receive court or supervised probation

Utah Felony Cases

A Felony is a much more significant crime than a misdemeanor. Penalties for a felony include serving time in a Utah State Prison and paying steep fines. There are four levels of felony charges in Utah:

Third degree

  • Examples: A third DUI offense within a ten year period, theft or check forgery of $1,000 to $5,000, aggravated assault, possession of cocaine or other controlled substance, possession of marijuana with intent to distribute, burglary of a building other than a place of residence
  • Possible penalties: One to five years in prison, and pay up to $5,000 in fines

Second degree

  • Examples: Theft or check forgery of amounts over $5,000, auto theft, residential burglary, robbery, kidnapping, forcible sexual abuse, intentional abuse of a child, perjury, manslaughter
  • Possible penalties: One to 15 years in prison, and up to $10,000 in fines

First degree

  • Examples: Aggravated burglary, robbery or arson, possession of a controlled substance with intent to distribute near a school, kidnapping a child, rape, murder
  • Possible penalties: A minimum of five years in prison, with a maximum sentence of life and up to $10,000 in fines

Capital offense

  • Example: Aggravated murder
  • Possible penalties: Life in prison, life in prison without parole, consecutive or concurrent life sentences, the death penalty (capital punishment)
